  1. INTRODUCTION
    • This Privacy Notice is intended to provide you with information on how WS Audiology Denmark A/S (“WSA Denmark”) and WS Audiology Canada Inc. (“WSA Canada”) collect, use, and disclose your personal information when you use this portal for professional hearing care providers (hereinafter, the “Portal”).
    • WSA Denmark and WSA Canada are referred to herein collectively as "WSA", "we", "us", "our."
    • WSA Denmark and WSA Canada are jointly and severally responsible for the collection, use, and disclosure (“processing”) of your personal information, which is any information about “you” as an individual.
    • This Privacy Notice explains how, and for which purposes we collect, use, and disclose your personal information. We will only process your personal information in accordance with this Privacy Notice and applicable law to which we are subject, which includes Canadian federal and provincial law and the General Data Protection Regulation (EU 2016/679) (the "GDPR") for WSA Denmark.

    • This Privacy Notice applies only to the collection, use, and disclosure of your personal information as an employee of a hearing care provider (B2B customer) of WSA within the Portal. If you are interacting with us in another way – e.g., as a user of one of our products or as a participant in a one-off survey – please refer to the information which was made available to you at the point of collection or by other appropriate means.

We will only collect, use, or disclose your personal information with your consent, which may be express or implied in some circumstances, or as otherwise authorized by applicable law.

ACCOUNT SET UP AND ONLINE-SHOP:

  • When you create a user profile on our Portal we collect your first name, last name, email address, job title, phone number, and your selected language. We will link your profile to the clinic you represent by asking you to specify the country where your clinic is located and the WSA customer number of your clinic. If and when you use our online-shop in the Portal we will use the above information to link the order you place to the clinic you represent

WHEN YOU RECEIVE MARKETING MATERIAL OR COMPLETE CONTACT FORMS:

  • If you complete the contact forms in the Portal or consent to receive marketing material such as newsletters from us, we collect personal information about you, including your name and your email address and any other information you provide to us in the form. We note that we have advised you not to provide any confidential or sensitive information in our form. You have the right to unsubscribe from any of our marketing communications at any time by contacting us (see below) or by clicking the “unsubscribe” link in those communications. Please note that even if you unsubscribe from receiving promotional materials, we may still send you email communication that is required to communicate with you about our business relations.

TRAINING AND EVENTS

  • When you use the Portal to sign up for training sessions or our events in general, we collect personal information about you, including your name, job title, your email address, the clinic you represent as well as information on the training session or event you have signed up to. If the event is a physical event, we may process other information you provide to us as part of the event including food preferences and, if relevant, accommodation requirements.

DATA COLLECTED AUTOMATICALLY AS PART OF YOUR USE OF THE PORTAL

  • When you use the Portal, we automatically collect cookies and other data about you and the way you use the Portal e.g., your browser type, how much you use a specific function and your IP-address. The purpose of our processing is to optimise the user experience and the Portal’s functionality including creating statistics. The information will be in aggregated form, and we will not use it to identify you. Please see our separate Cookie Policy for further details which can be accessed via the “Consent settings” on the Portal.
  • If we intend to use your personal information for other purposes than those for which the personal information was initially collected, we will - prior to this further use - inform you of the new purpose or obtain your consent, as required under applicable law.
  1. HOW IS YOUR PERSONAL INFORMATION COLLECTED
    • We will collect your personal information from you and from your use of the Portal.
  2. WHO WE SHARE YOUR PERSONAL INFORMATION WITH
    • We only share your personal information with others to the extent necessary and in accordance with applicable law and regulations.
    • We may disclose your personal information to external service providers acting on strict instructions from us for technical support, to evaluate the usefulness of the Portal or for other types of administrative or technical services that are carried out in the course of our business activities. Such external service providers will not process or disclose your personal information for their own purposes, and WSA ensures that they offer sufficient guarantees with respect to the security and confidentiality of the personal information which they may be given access to.
    • We may share some information regarding your Portal use with external service providers for analytical purposes by means of cookies or similar techniques. We only share such information if you accept the use of cookies. You can opt-out at any time, and for further information please refer to our Cookie Policy, which can be accessed via the “Consent settings” on the Portal.
  3. TRansfer of your personal information outside CANADA
    • In order to provide our services to you, your personal information may be transferred to our affiliates or service providers outside of Canada or the province in which it was collected, including to the United States. We use Microsoft’s servers that are located in Ireland and Holland, and your personal information will be transferred from Canada to those locations. However, Microsoft may transfer your personal information to a country outside the European Economic Area, including but not limited to the US. Please note that while information is located outside of Canada, it will be subject to the laws of that jurisdiction. While we have contractual safeguards in place, these laws may be less protective of your personal information than those that are in force in Canada.
    • Please also be advised that your personal information may also be transferred to a country outside Canada or the European Economic Area by our use of cookies on the Portal. You can read more on this in our Cookie Policy, which can be accessed via the “Consent settings” on the Portal.
  4. how long we keep your personal information
    • We only retain your personal information for as long as necessary to fulfil the purposes for which the data was collected, including for the purposes of satisfying any legal, accounting or reporting requirements. Below we have described the specific retention periods for your personal information:
  • Your account information (see section 1), will be deleted automatically if you have not logged into your account for a period of 12 months. We will also delete your account information if the clinic you represent terminates its agreement with us.
  • Personal information collected as part of placing an order in our online-shop (see section 1) will be deleted in accordance with the applicable bookkeeping regulation.
  • Personal information collected as part of a contact form (see section 2) will be deleted after three months.
  • Personal information collected in relation to sending you marketing material will be deleted when you opt-out from receiving such marketing material. Please note that in some countries you are required to provide a consent to receive such marketing material. In those countries we retain documentation on your consent in accordance with the applicable statute of limitation in those countries.
  • Personal information collected as part of signing up to and participating in training sessions and events will be deleted after three months.
  • Personal information about your use of our Portal, will be deleted in accordance with our Cookie Policy, see more in the “Consent settings” on the Portal.

 

  1. SAFEGUARDING YOUR INFORMATION

8.1       Only authorized personnel, who have a business need to know, have access to your personal information. We inform these employees of their obligations to safeguard your personal information. We use reasonable technical, contractual, and administrative measures to protect your personal information against its unauthorized use or disclosure as well as its loss or theft. Our employees who have access to your personal information may use it only in accordance with the principles set out in this Privacy Notice and applicable legislation.

Under certain circumstances, you have the right to:

  1. Request access to your personal information. This enables you to receive details of our processing of your personal information and a copy of the personal information we hold about you.
  2. Request correction of the personal information that we hold about you when this information is incomplete or inaccurate.
  3. Request deletion of your personal information when it is no longer required for the purposes for which it was collected.
  4. Withdraw your consent regarding the processing of your personal information at any time. After the withdrawal of your consent, we will stop the processing as soon as possible. However, the withdrawal of your consent does not affect the lawfulness of the processing before consent was withdrawn. Withdrawal of your consent (except for marketing purposes) could also affect the provision of our products and services to you.

If you are located in the province of Quebec, we must reply to your request for access, rectification or deletion, or to any complaint regarding the protection of your personal information, promptly and no later than 30 days after your request is received. Should you not be satisfied with our response or you wish to file a formal complaint, you may always contact the Office of the Privacy Commissioner of Canada at 1-800-282-1376 (toll-free) or via regular mail: Office of the Privacy Commissioner of Canada, 30 Victoria Street, Gatineau, QC K1A 1H3. You may also contact the Office of the Privacy Commissioner in the provinces of British Columbia and Alberta or the Commission d’accès à l’information in the province of Quebec, as applicable.
